Today the S&P/Case-Shiller Index report for February was released showing home prices continue to fall and that the housing housing market continues to head toward a double dip in home prices. The report shows their 20-city composite home price index declined by 1.1 percent from the month before and declined by 3.3 percent from a year ago.
Over the past year or so there have been dozens, if not hundreds, of stories questioning the manner in which lenders were handling the servicing of their loans, particularly those of underwater borrowers, as well as the foreclosure practices of many including “robo-signing” of foreclosure affidavits. Next came the lawsuits and now, this week, the Federal Reserve Board announced formal enforcement actions requiring 10 banking organizations to address “a pattern of misconduct and negligence related to deficient practices in residential mortgage loan servicing and foreclosure processing.”

RealtyTrac released their foreclosure report for the first quarter of 2011 which shows foreclosure filings were reported on 681,153 U.S. properties during the quarter, a 15 percent decrease from the previous quarter and a 27 percent decrease from the first quarter of 2010. St. Louis did not see as big of a decrease but still the numbers are looking better! Forty three years ago today, President Lyndon Baines Johnson signed into law the Civil Rights Act of 1968 which included Title VIII, the Fair Housing Act which, as described on HUD’s website, “prohibits discrimination in the sale, rental, and financing of dwellings, and in other housing-related transactions, based on race, color, national origin, religion, sex, familial status (including children under the age of 18 living with parents or legal custodians, pregnant women, and people securing custody of children under the age of 18), and handicap (disability).“
UPDATE Jan, 2013 – Congress approved extending the Mortgage Forgiveness Debt Relief Act of 2007 through the end of 2013.
I first wrote an article on this topic a little over two years ago as the foreclosure rate was rising and borrowers were concerned about where they stood with the IRS with regard to “mortgage forgiveness”. Well, here we are today with the same issues looming over many people, so I thought I would do an update.
Yesterday, four fair housing organizations released their findings of a year-long undercover investigation of 80 loan modification companies, which reveal an industry rife with corrupt practices. The National Fair Housing Alliance, the Connecticut Fair Housing Center, Housing Opportunities Made Equal of Virginia, Inc., and the Miami Valley Fair Housing Center issued a report entitled, “Have I Got a Deal for You! An Undercover Investigation of Mortgage Loan Modification Scams,” which documents the tactics mortgage modification scammers use to take money from vulnerable homeowners.
My guess is you read the headline, chuckled and said to yourself “no way”. After all, the idea of sending people that could not pay their debts to prison went away over a century ago in the U.S., right? Yes and no….In 1833 the United States abolished Federal imprisonment for unpaid debts and most states did as well around the same time. However, Missouri Representative Gary L. Cross, representing the Kansas City area, has introduced legislation that would subject tenants that do not pay their rent to a criminal charge, a Class A Misdemeanor to be exact.

The St. Louis foreclosure rate increased 1.7 percent in January to 1.79 percent, according to a report published by CoreLogic. On a positive note, the report shows that the rate of serious mortgage delinquencies in St. Louis (90+ days delinquent) decreased slightly to 5.14 percent in December from 5.18 percent the month before.
Most Americans are opposed to the idea according to recent survey

A report released this morning by CoreLogic shows that the current residential “shadow” inventory as of January 2011 declined to 1.8 million units, down slightly from 2.0 million units a year ago. This current shadow inventory represents a 9 month supply, same as the suply a year ago.
A report issued by Lender Processing Services, one of the countries largest loan servicers and aggregators of loan performance data, shows that while mortgage delinquencies continue to decline, an enormous backlog of foreclosures still exists and is expected to continue for some time. As of the end of February, foreclosure inventory levels stand at more than 30 times the monthly foreclosure sales volume.
RPX Composite Home Price Fell to Lowest Level since April 2003
Radar Logic published it’s Housing Market Report for January showing that it’s “RPX Composite Price” fell 3.8 percent from December and 3.4 percent from the year before.
Today, the U.S. Department of Housing and Urban Development and U.S. Census Bureau released new home sales data for February 2011 showing a decrease of 16.9 percent from the month before, and a decrease of 28.0 percent from a year ago.
The seasonally-adjusted new home sales rate for February was 250,000 homes. The supply of new homes on the market increased from an adjusted 7.4 month supply the month before to a 8.9 month supply in February. On a positive note, the report shows that the rate of serious mortgage delinquencies in St. Louis (90+ days delinquent) decreased slightly to 5.14 percent in December from 5.18 percent the month before.
Radar Logic published it’s “RPX Year in Review 2010” for the U.S. real housing market which illustrates the significant negative impact distressed sales have on home prices and the real estate market as a whole. The report reveals that “motivated sales” (sales that include REO’s, sales by financial institutions, short-sales, etc) made up less than 5 percent of the home sales in the 25 major metropolitan areas covered by the report until 2007 when the rate rose above 5 percent, ultimately peaked in 2009 at around 38 percent and then last year settled in around the 31 percent mark.
Nearly nine out of 10 homeowners say they would buy their homes again.
Despite the financial blood-shed the real estate market downturn has caused many homeowners, Americans still have a deep-rooted attachment to home ownership according to the Allstate-National Journal Heartland Monitor Poll. The poll, funded by Allstate Corporation revealed that nearly nine out of 10 homeowners surveyed said they would buy their homes again. St. Louis Foreclosure Activity in February declines 40 Percent More in St. Louis than overall U.S.
RealtyTrac just released their foreclosure activity report for February showing foreclosure activity in the St. Louis metro area declined 19.6 percent from the month before and was down 17.86 percent from a year ago. The U.S. foreclosure rate declined 14 percent in February.

Radar Logic is a company that publishes a home price index (the RPX Index) that is based upon the price per foot homes are selling for, versus actual sale prices of homes. Not providing a current mailing address to the Assessors office can cost you your home
Mohammad Bhatti learned this the hard way. Bhatti, a resident of the City of St. Louis, purchased a property at 3243 Pennsylvania in 2005 to rehab and resell. From court records I reviewed it appears that the city had the property address as Mr. Bhatti’s mailing address rather than where he was actually living. This is something that would ultimately cost Mr. Bhatti to lose his property at 3243 Pennsylvania, which he claims to be worth $169,900, over $1,452.06 in delinquent property taxes.

RealtyTrac released their foreclosure report for 2010 showing that foreclosure homes accounted for nearly 26 percent of all U.S. residential sales during the year. This is down from 2009 when 29 percent of all sales were foreclosure homes.
The Mortgage Bankers Association released the results of it’s National Delinquency Survey for the 4th quarter of 2010 and it shows very mixed results. On the positive side of things, overall mortgage loan delinquency in the U.S. has dropped to 8.22 percent which is the lowest rate since 4th quarter 2008 when the rate was 7.88 percent. On the flip side of the coin, the overall foreclosure rate for the quarter was 4.63 percent which ties the highest rate on record which was hit in the 1st quarter of 2010.
Much has been written (including by me) about the negative impact foreclosures and other distress sales have on home prices so this is no new issue. In fact, most readers have probably seen (or felt) the impact of this in their own neighborhood.

This past Friday Federal Reserve Board Governor Sarah Bloom Raskin spoke at the 2011 Midwinter Housing Finance Conference about the powerful impact the housing and mortgage markets have had on the nation’s economy recovery.

St. Louis bucks the national foreclosure trend…in the wrong way..
Earlier today I wrote that the U.S. foreclosure rate for January was up 1 percent from December and down 17 percent from the year before….unfortunately the numbers for St. Louis are not that good at all and in fact much worse. According to data released by RealtyTrac, the St. Louis Metro Area foreclosure rate in January 2011 rose almost 9 percent from December (8.76 percent) and was up 14.77 percent from January 2010.
RealtyTrac released their foreclosure report for January 2011 showing there were foreclosure filings in January on 261,333 U.S. properties, a 1 percent increase from December but a 17 percent decrease from January 2010.
A federal grand jury indicted a Brookwood man yesterday on wire fraud and false statement charges related to a more than $1 million mortgage fraud scheme in the Birmingham area, announced U.S. Attorney Joyce White Vance.
A 34-count indictment filed in U.S. District Court charges SCOTT ERIC PERRY, 34, with 17 counts of wire fraud and 17 counts of making false statements to lending institutions in connection to real estate transactions between February and December, 2006.
Today Richard W. Northcutt, a California real estate investor, pleaded guilty to conspiring with a group of real estate speculators who agreed not to bid against each other at certain public real estate foreclosure auctions in San Joaquin County. According to the court documents the primary purpose of the conspiracy was to suppress and restrain competition and to obtain selected real estate offered at these foreclosure auctions at non-competitive prices.
RealtyTrac released their foreclosure report for 2010 which showed some mixed results. During 2010 there were 2,871,891 foreclosure filings in the U.S., an increase of 1.67 percent from 2009. However the metro areas with the 10 highest foreclosure rates all saw decreases in foreclosure filings in 2010 from the year before, in fact six of the ten metros even had decreased foreclosure activity from 2008.
